{"id":330,"date":"2008-08-11T19:21:21","date_gmt":"2008-08-11T17:21:21","guid":{"rendered":"http:\/\/frick.fr\/airap\/?p=330"},"modified":"2008-08-11T19:21:21","modified_gmt":"2008-08-11T17:21:21","slug":"la-responsabilite-des-notaires-et-des-agents-immobiliers","status":"publish","type":"post","link":"https:\/\/airap.asso.fr\/?p=330","title":{"rendered":"La responsabilit\u00e9 des Notaires et des Agents immobiliers"},"content":{"rendered":"<p>A l&rsquo;occasion d&rsquo;une acquisition, le\u00a0devoir de conseil du Notaire, et\/ou de l&rsquo;Agence immobili\u00e8re\u00a0lorsqu&rsquo;elle intervient,\u00a0est fondamental.<\/p>\n<p>Dans le cas particulier actuel des communes de Chamonix et des Houches, l&rsquo;existence de projets de PPR Avalanches (Plan de Pr\u00e9vention des Risques), pr\u00e9sent\u00e9s en enqu\u00eate publique en mairie en juillet et ao\u00fbt 2007, doit donc \u00eatre signal\u00e9e par ces professionnels qui ne peuvent l&rsquo;ignorer.<\/p>\n<p>Les \u00e9l\u00e9ments\u00a0nouveaux dans l&rsquo;analyse des risques d&rsquo;avalanches qu&rsquo;apportent ces PPR A en cours d&rsquo;approbation sont extr\u00eamement\u00a0importants et permettent une approche nouvelle du danger pour les biens et\/ou les personnes, qu&rsquo;il serait dangereux de passer sous silence<\/p>\n<p><!--more--><\/p>\n<p>La cr\u00e9ation des \u00ab\u00a0zones jaunes\u00a0\u00bb pr\u00e9cis\u00e9es dans le cadre de l&rsquo;AMV, Al\u00e9a Maximum Vraisemblable, permet d&rsquo;analyser les risques d&rsquo;une mani\u00e8re beaucoup plus fine.<\/p>\n<p>Voir dans\u00a0<a href=\"http:\/\/www.prim.net\/\">www.prim.net<\/a>\u00a0\/ annuaires des sites \/ les avalanches \/ sites institutionnels \/ plan de pr\u00e9vention des risque d&rsquo;avalanches.<\/p>\n<p>Voir plus particuli\u00e8rement les pages 56, 57, 59, 61, 77, et 80 du chapitre 4 qui d\u00e9finissent et pr\u00e9cisent la notion de \u00ab\u00a0zones jaunes\u00a0\u00bb.<\/p>\n<p>Voir, ci-joint, la cartographie des zones de risques, zones rouges, bleues et\u00a0<u><strong>jaunes<\/strong><\/u>\u00a0telles que pr\u00e9sent\u00e9es dans les cartes r\u00e9glementaires et d&rsquo;al\u00e9as des communes de Chamonix et des Houches. Cette cartographie fait partie int\u00e9grante des projets de PPR Avalanches de ces communes, pass\u00e9s en enqu\u00eate publique en juillet et ao\u00fbt 2007 et en attente de validation par le Pr\u00e9fet.<\/p>\n<p>Ces cartes ont \u00e9t\u00e9 transmises aux notaires de la vall\u00e9e de Chamonix et de Bonneville par l&rsquo;AIRAP, pour pallier leur \u00e9ventuelle absence d&rsquo;int\u00e9r\u00eat pour l&rsquo;\u00e9volution de ce sujet pourtant essentiel au bon exercice de leur m\u00e9tier, ou leur incapacit\u00e9 \u00e0 consulter ou obtenir les documents pr\u00e9sent\u00e9s lors de l&rsquo;enqu\u00eate publique.<\/p>\n<p>Il est, sans doute, plus que souhaitable que les Chambres professionnelles concern\u00e9es puissent avoir, aupr\u00e8s d&rsquo;eux, un r\u00f4le de sensibilisation sur ce th\u00e8me.
